a spokeswoman said.<\/p>\n<p>At a High Court hearing in London, Eurotunnel claimed the government contracts, <a href=\"https:\/\/www.bbc.co.uk\/news\/business-46704522\" class=\"story-body__link\">announced on 29 December<\/a>, were awarded without any public notice.<\/p>\n<p>Eurotunnel&#8217;s barrister Daniel Beard QC said Eurotunnel only found out &#8220;when contract notices were published three days after Christmas&#8221;. <\/p>\n<p>He said it was &#8220;quite remarkable&#8221; his client had not been informed given its recent history in running cross-Channel services.<\/p>\n<p>Ewan West, representing Transport Secretary Chris Grayling in court, said the government&#8217;s procurement process was only for &#8220;maritime freight&#8221; services and that Eurotunnel &#8220;could never have provided that capacity&#8221; and &#8220;could not have complied&#8221; with the terms of the contracts.<\/p>\n<p>Judge Peter Fraser ruled a four-day trial will begin on 1 March given the &#8220;obvious&#8221; situation of &#8220;extreme urgency&#8221; meant there was no time for the contracts to be put out to tender &#8211; the standard practice for public procurements.<\/p>\n<p>However, the BBC understands that a number of firms were considered and there was a private negotiation process.<\/p>\n<p>Three suppliers were awarded a total of \u00a3102.9m in late December, aimed at easing &#8220;severe congestion&#8221; at Dover, in the case of a no-deal Brexit:<\/p>\n<ul class=\"story-body__unordered-list\">\n<li class=\"story-body__list-item\">\u00a346.6m to the French company Brittany Ferries<\/li>\n<li class=\"story-body__list-item\">\u00a342.5m (\u20ac47.3m) to Danish shipping firm DFDS<\/li>\n<li class=\"story-body__list-item\">\u00a313.8m to British firm Seaborne Freight<\/li>\n<\/ul>\n<p>The decision to award a contract to Seaborne, a firm with no ships <a href=\"https:\/\/www.bbc.co.uk\/news\/business-46714984\" class=\"story-body__link\">which the BBC found had never run a ferry service before<\/a>, has been heavily criticised.<\/p>\n<p>After Seaborne&#8217;s contract collapsed Mr Grayling faced calls for his resignation, with Labour accusing him of &#8220;rewriting the textbook on incompetence.&#8221;.<\/p>\n<p>But Prime Minister Theresa May has said she continues to have full confidence in him.<\/p>\n<\/p><\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.bbc.co.uk\/news\/business-47206303\">Source<\/a> by <a href=\"\">[author_name]<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Image copyright AFP The government is being sued for its decision to charter firms to run extra ferries, including one with no ships, in the event of a no-deal Brexit.
