{"id":7104,"date":"2019-02-04T13:44:42","date_gmt":"2019-02-04T13:44:42","guid":{"rendered":"http:\/\/www.styledeals.co.uk\/blog\/cadbury-loses-legal-battle-over-purple-wrapper\/"},"modified":"2019-02-04T13:44:42","modified_gmt":"2019-02-04T13:44:42","slug":"cadbury-loses-legal-battle-over-purple-wrapper","status":"publish","type":"post","link":"https:\/\/www.styledeals.co.uk\/blog\/cadbury-loses-legal-battle-over-purple-wrapper\/","title":{"rendered":"Cadbury loses legal battle over purple wrapper"},"content":{"rendered":"\n<div property=\"articleBody\">\n<figure class=\"media-landscape no-caption full-width lead\"><span class=\"image-and-copyright-container\"><\/p>\n<p>                <img loading=\"lazy\" decoding=\"async\" class=\"js-image-replace\" alt=\"Cadbury's Dairy Milk Chocolate bars move down the production line at the Cadbury's Bournville production plant\" src=\"https:\/\/ichef.bbci.co.uk\/news\/320\/cpsprodpb\/12292\/production\/_105468347_gettyimages-94471352.jpg\" width=\"976\" height=\"549\"\/><span class=\"off-screen\">Image copyright<\/span><br \/>\n                 <span class=\"story-image-copyright\">Getty Images<\/span><\/p>\n<p>            <\/span><\/p>\n<\/figure>\n<p class=\"story-body__introduction\">Cadbury has lost more ground in its long-running battle to protect the particular purple it uses to wrap its chocolate.<\/p>\n<p>After losing an appeal last month, Cadbury has given up a trademark.<\/p>\n<p>Lawyers said the company may have decided the trademark application is unenforceable after a court ruled it was too wide-ranging.<\/p>\n<p>The move makes it harder for Cadbury to stop a rival from using a similar colour for its products, a lawyer said.<\/p>\n<p>In 2012 Cadbury won a case to stop other chocolate firms using the colour &#8211; known as Pantone 2865c.<\/p>\n<p>Nestle challenged that, and in 2013 won an appeal.<\/p>\n<p>The Court of Appeal said at the time the trademark application lacked &#8220;the required clarity, precision, self-containment, durability and objectivity to qualify for registration&#8221;.<\/p>\n<h2 class=\"story-body__crosshead\">&#8216;Very strict&#8217;<\/h2>\n<p>Cadbury&#8217;s original trademark application aimed to protect the colour &#8220;applied to the whole visible surface, or being the predominant colour&#8221; of the wrappers on bars and tablets of chocolate.<\/p>\n<p>It is the &#8220;predominant&#8221; part that is seen as the problem, Rebecca Anderson-Smith, a trade mark attorney at Mewburn Ellis in Bristol, told the BBC.<\/p>\n<p>&#8220;I think the courts and trademark offices are very strict with colour trademarks,&#8221; she said. &#8220;They don&#8217;t want to give anyone a monopoly on the colour purple.&#8221;<\/p>\n<p>It will now be &#8220;harder for Cadbury to stop a third party from using a similar colour,&#8221; she said. <\/p>\n<p>Cadbury&#8217;s most recent move was to claim the trade mark had two parts and then remove the part that was about predominant colour. <\/p>\n<p><a href=\"https:\/\/www.bailii.org\/ew\/cases\/EWCA\/Civ\/2018\/2715.html\" class=\"story-body__link-external\">This failed in December<\/a>. And the company then dropped a 1995 trademark with similar wording, probably realising it was unenforceable, she said.<\/p>\n<h2 class=\"story-body__crosshead\">Brand defence <\/h2>\n<p>Will we be seeing rivals pounce and sell chocolates with a similar colour?<\/p>\n<p>&#8220;We have not appealed but will continue to protect what we believe is a distinctive trademark,&#8221; Cadbury&#8217;s US owner Mondelez, said.<\/p>\n<p>Cadbury does have at least one more trademark from 2004,  said Ms Anderson-Smith, although it uses similar wording.<\/p>\n<p>Finally, the company could argue that it has unregistered trademark rights.<\/p>\n<p>Those protect customers from being confused by firms that deliberately make products that look similar to established brands.<\/p>\n<p>But this would be a much harder thing to enforce, Ms Anderson-Smith said, since extensive use of the trade mark must be proved.<\/p>\n<\/p><\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.bbc.co.uk\/news\/business-47113644\">Source<\/a> by <a href=\"\">[author_name]<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Image copyright Getty Images Cadbury has lost more ground in its long-running battle to protect the particular purple it uses to wrap its chocolate.
