{"id":6560,"date":"2019-01-21T18:48:47","date_gmt":"2019-01-21T18:48:47","guid":{"rendered":"http:\/\/www.styledeals.co.uk\/blog\/google-hit-with-44m-gdpr-fine-over-ads\/"},"modified":"2019-01-21T18:48:47","modified_gmt":"2019-01-21T18:48:47","slug":"google-hit-with-44m-gdpr-fine-over-ads","status":"publish","type":"post","link":"https:\/\/www.styledeals.co.uk\/blog\/google-hit-with-44m-gdpr-fine-over-ads\/","title":{"rendered":"Google hit with \u00a344m GDPR fine over ads"},"content":{"rendered":"\n<div property=\"articleBody\">\n<figure class=\"media-landscape no-caption full-width lead\"><span class=\"image-and-copyright-container\"><\/p>\n<p>                <img loading=\"lazy\" decoding=\"async\" class=\"js-image-replace\" alt=\"Google logo\" src=\"https:\/\/ichef.bbci.co.uk\/news\/320\/cpsprodpb\/0288\/production\/_105284600_44935b21-9f20-4727-a2c0-84bef85a4548.jpg\" width=\"976\" height=\"489\"\/><span class=\"off-screen\">Image copyright<\/span><br \/>\n                 <span class=\"story-image-copyright\">Reuters<\/span><\/p>\n<p>            <\/span><\/p>\n<\/figure>\n<p class=\"story-body__introduction\">Google has been fined 50 million euros (\u00a344m) by the French data regulator CNIL, for a breach of the EU&#8217;s data protection rules.<\/p>\n<p>CNIL said it had levied the record fine for &#8220;lack of transparency, inadequate information and lack of valid consent regarding ads personalisation&#8221;.<\/p>\n<p>The regulator said it judged that people were &#8220;not sufficiently informed&#8221; about how Google collected data to personalise advertising.<\/p>\n<p>In a statement, Google said it was &#8220;studying the decision&#8221; to determine its next steps.<\/p>\n<ul class=\"story-body__unordered-list\">\n<li class=\"story-body__list-item\"><a href=\"https:\/\/www.bbc.co.uk\/news\/technology-46944694\" class=\"story-body__link\">Amazon, Apple, Google, Netflix and Spotify face GDPR complaint<\/a><\/li>\n<\/ul>\n<p>Complaints against Google were filed in May 2018 by two privacy rights groups: noyb and La Quadrature du Net (LQDN). <\/p>\n<p>The first complaint under the EU&#8217;s new General Data Protection Regulation (GDPR) was filed on 25 May 2018, the day the legislation took effect.<\/p>\n<p>The groups claimed Google did not have a valid legal basis to process user data for ad personalisation, as mandated by the GDPR.<\/p>\n<figure class=\"media-with-caption\">\n<div class=\"player-with-placeholder\">\n            <img decoding=\"async\" class=\"media-placeholder player-with-placeholder__image narrative-video-placeholder\" src=\"https:\/\/ichef.bbci.co.uk\/images\/ic\/720x405\/p0667j3j.jpg\"\/><\/p>\n<p>Media playback is unsupported on your device<\/p>\n<\/p><\/div><figcaption class=\"media-with-caption__caption\"><span class=\"off-screen\">Media caption<\/span>WATCH: What is GDPR?<\/figcaption><\/figure>\n<p>Although Google&#8217;s European headquarters is in Ireland, it was decided among the authorities that the case would be handled by the French data regulator, since the Irish watchdog did not have &#8220;decision-making power&#8221; over its Android operating system and its services.<\/p>\n<h2 class=\"story-body__crosshead\">A lack of transparency<\/h2>\n<p>The regulator said Google had not obtained clear consent to process data because &#8220;essential information&#8221; was &#8220;disseminated across several documents&#8221;.<\/p>\n<p>&#8220;The relevant information is accessible after several steps only, implying sometimes up to five or six actions,&#8221; the regulator said.<\/p>\n<p>&#8220;Users are not able to fully understand the extent of the processing operations carried out by Google.&#8221;<\/p>\n<h2 class=\"story-body__crosshead\">No valid consent<\/h2>\n<p>Additionally, the regulator said Google had failed to obtain a valid legal basis to process user data.<\/p>\n<p>&#8220;The information on processing operations for the ads personalisation is diluted in several documents and does not enable the user to be aware of their extent,&#8221; it said.<\/p>\n<p>It said the option to personalise ads was &#8220;pre-ticked&#8221; when creating an account, which did not respect the GDPR rules. <\/p>\n<p>&#8220;The user gives his or her consent in full, for all the processing operations purposes carried out by Google based on this consent (ads personalisation, speech recognition, etc).<\/p>\n<p>&#8220;However, the GDPR provides that the consent is &#8216;specific&#8217; only if it is given distinctly for each purpose.&#8221;<\/p>\n<p>The regulator said it was Google&#8217;s &#8220;utmost responsibility to comply with the obligations on the matter&#8221;.<\/p>\n<p>In a statement, Google said: &#8220;People expect high standards of transparency and control from us.
