{"id":3039,"date":"2018-10-09T04:48:40","date_gmt":"2018-10-09T04:48:40","guid":{"rendered":"http:\/\/www.styledeals.co.uk\/blog\/morrisons-appealing-over-staff-data-leak-compensation\/"},"modified":"2018-10-09T04:48:40","modified_gmt":"2018-10-09T04:48:40","slug":"morrisons-appealing-over-staff-data-leak-compensation","status":"publish","type":"post","link":"https:\/\/www.styledeals.co.uk\/blog\/morrisons-appealing-over-staff-data-leak-compensation\/","title":{"rendered":"Morrisons appealing over staff data leak compensation"},"content":{"rendered":"\n<div property=\"articleBody\">\n<figure class=\"media-landscape has-caption full-width lead\"><span class=\"image-and-copyright-container\"><\/p>\n<p>                <img loading=\"lazy\" decoding=\"async\" class=\"js-image-replace\" alt=\"Morrisons store\" src=\"https:\/\/ichef.bbci.co.uk\/news\/320\/cpsprodpb\/AD99\/production\/_99014444_hi043313304.jpg\" width=\"976\" height=\"549\"\/><span class=\"off-screen\">Image copyright<\/span><br \/>\n                 <span class=\"story-image-copyright\">Chris Radburn<\/span><\/p>\n<p>            <\/span><figcaption class=\"media-caption\"><span class=\"off-screen\">Image caption<\/span><br \/>\n                <span class=\"media-caption__text\"><br \/>\n                    More than 5,000 current and former employees are seeking compensation from Morrisons<br \/>\n                <\/span><br \/>\n            <\/figcaption><\/figure>\n<p class=\"story-body__introduction\">A legal battle for compensation by thousands of Morrisons staff whose personal details were posted online by a disgruntled employee has reached the Court of Appeal.<\/p>\n<p><a href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-42193502\" class=\"story-body__link\">The High Court ruled last year<\/a> that the supermarket was liable for the release of information and its employees were entitled to compensation.<\/p>\n<p>The case is the first data leak class action in the UK. <\/p>\n<p>The proceedings are due to take place on Tuesday. <\/p>\n<p>Morrisons&#8217; appeal has significant implications for other organisations, who could also be found liable to pay compensation for the acts of rogue employees. <\/p>\n<ul class=\"story-body__unordered-list\">\n<li class=\"story-body__list-item\"><a href=\"http:\/\/www.bbc.co.uk\/news\/uk-england-42193502\" class=\"story-body__link\">Morrisons liable for staff data leak<\/a><\/li>\n<li class=\"story-body__list-item\"><a href=\"http:\/\/www.bbc.co.uk\/news\/uk-england-leeds-33566633\" class=\"story-body__link\">Data leak: Morrisons worker jailed<\/a><\/li>\n<\/ul>\n<p>In 2014 Andrew Skelton, then a senior internal auditor at Morrisons&#8217; Bradford headquarters, leaked the payroll data of more than 100,000 employees, including their names, addresses, bank account details and salaries.<\/p>\n<p>A court subsequently heard that he harboured a &#8220;considerable grudge&#8221; against the company after he was accused of dealing drugs known as legal highs at work. <\/p>\n<p>In July 2015 Skelton was found guilty of fraud and disclosing personal data and jailed for eight years. <\/p>\n<p>Morrisons spent more than \u00a32m on measures to tackle the breach. <\/p>\n<p>But last year the High Court ruled the supermarket was vicariously liable as, despite Skelton&#8217;s criminality, he was acting in the course of his employment when he leaked the information online. <\/p>\n<p>This meant a group of more than 5,000 former and current employees, exposed to the risk of identity theft and potential financial loss, were entitled to compensation. <\/p>\n<h2 class=\"story-body__crosshead\">&#8216;David and Goliath&#8217;<\/h2>\n<p>The supermarket said it could not be held directly or vicariously liable for the criminal misuse of the data and is to challenge the decision at a hearing on Tuesday.<\/p>\n<p>Nick McAleenan, of JMW Solicitors,  who is representing the claimants, described the dispute as a &#8220;classic David and Goliath case&#8221;.<\/p>\n<p>He said by seeking to reverse the High Court ruling, Morrisons was denying the claimants any compensation for &#8220;the considerable distress and inconvenience caused by Mr Skelton&#8217;s actions&#8221;.<\/p>\n<p>&#8220;It cannot be right that there is no legal recourse where employee information has been handed to one of the largest companies in the UK and then leaked on such a large scale, in such circumstances,&#8221; he said. <\/p>\n<\/p><\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.bbc.co.uk\/news\/uk-45793598\">Source<\/a> by <a href=\"\">[author_name]<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Image copyright Chris Radburn Image caption More than 5,000 current and former employees are seeking compensation from Morrisons A legal battle for compensation by thousands of Morrisons staff whose personal details were posted online by a disgruntled employee has reached the Court of Appeal.
