Dominic Chappell, the former owner of BHS, has had his appeal dismissed by a judge who said he gave “entirely unbelievable” evidence.<\/p>\n

Mr Chappell was convicted for failing to provide information to the Pensions Regulator (TPR) and ordered to pay \u00a387,000 in January.<\/p>\n

Department store BHS collapsed with the loss of 11,000 jobs and a pension deficit of \u00a3571m.<\/p>\n

Mr Chappell bought BHS for just \u00a31 from billionaire Sir Philip Green in 2015.<\/p>\n

The businessman, who gave his address as Clenston Manor, near Blandford, Dorset, was issued with two notices under the Pensions Act 2004, in March and April 2016, before being handed a warning notice in November that year.<\/p>\n

Alex Stein, prosecuting, told the appeal hearing at Hove Crown Court that the crux of the case was that Chappell “failed to respond” to the three statutory notices.<\/p>\n

Judge Christine Henson QC said the majority of his answers during the hearing were “not credible”.<\/p>\n

“We are sure Mr Chappell had access to information which would allow him to answer the majority of information required,” she said.<\/p>\n

Investigation<\/h2>\n

Mr Chappell claimed he had been locked out of the department store’s offices, and that all his documentation regarding BHS had been on a single memory stick which had been seized by HM Revenue and Customs. <\/p>\n

He also said that he had delegated the TPR information requests to his solicitor. <\/p>\n

BHS went into administration in April 2016, just 13 months after it was bought by Mr Chappell from Sir Philip.<\/p>\n

TPR opened an investigation into the sale over concerns about two of the company’s pension schemes representing 19,000 members of staff.<\/p>\n

The regulator accused Sir Philip of making the sale to dodge responsibility<\/a> for the pension schemes in the event the firm should go bust.<\/p>\n

Sir Philip later agreed a \u00a3363m cash settlement to partly cover the pension costs.<\/p>\n<\/p><\/div>\n
